KamberEdelson, LLC Announces Mobile Content Settlement With Mobile Messenger Americas, Inc.
A settlement has been reached with Mobile Messenger in class action litigation involving claims that unauthorized charges for “mobile content” were placed on the cell phone bills of consumers throughout the country. The settlement, which was preliminarily approved by the U.S. District Court in Miami last week, entitles wireless customers across the country to receive refunds for unauthorized mobile content charges. Mobile Messenger has denied any wrongful conduct.
Mobile content refers to products such as ringtones, games, graphics, news, and other alerts that generally are received via text messages on mobile phones and are charged directly to customers’ mobile phone bills. Although a relatively new form of commerce, mobile content has evolved to form a large and increasingly important industry. Mobile Messenger acts as an intermediary, between content providers, marketers and mobile operators, providing clients with advice on consumer protection, billing and payment, and direct customer support for users purchasing mobile content through its system.
The lawsuit alleged that there were not adequate safeguards in place to ensure that customers are only billed for services they agreed to purchase. This settlement is the first nationwide settlement with a company of this kind and follows a similar settlement reached with AT&T Mobility, LLC over similar issues. Attorneys Jay Edelson, Myles McGuire and Ryan D. Andrews of KamberEdelson, LLC, were appointed by the Court to serve as the attorneys for the class. “Mobile Messenger has decided to demonstrate leadership in improving this growing industry,” explained McGuire. “We expect that this settlement will put a lot of pressure on others to follow Mobile Messenger’s lead.”

Yeah right Denise. Here is the truth. Email I sent: “Your marketing is very deceptive. I read the T&C’s but I was at no time under the impression I was buying something. The reason I became suspect was the manner in which this was so confusing that it looked like you were trying to hide the true intent of the website. You well know that every person that goes down this path is looking for the results of the “iq test”
and not agreeing to spend $9,99. I have followed your instructions and cancelled my “subscription” minutes after realizing what you were trying to do. Please do not charge me for anything I do not want your services.
Can you confirm that I will not be charged for anything ?”
Their response:
“We have ensured that your mobile/ cell has been unsubscribed from any service.”
I still got charged the $9.99 and the subscription was not canceled.

These MM people are so FOS. I have been trying to get a refund since 2007 for fradulant charges on my cell phone account. I have been promised a refund, ye it has never arrived. I finally escalated this to my state’s Attorney General. We’ll see what, if anything, happens now.

To stop there unwanted service you have to reply with a text using the word “stop” or “quit”. I just called verizon who took the charge off my bill and blocked any more content like these people unknowingly sign you up for.

I texted them twice prior to my receiving a text saying they had cnacelled my subscription I never asked for. Verizon told me you have to use the words stop or quit as that is what there program recognizes. I hate people whom sink so low to make money by hassleing other people.

These MF’ing bastards need their as#es whupped in a dark alley. They got ahold of one of my numbers last month and put this BS charge on there. So I called the carrier and got a refund from them (the carrier). The carrier gave me an email address to send a cancellation request – which I did. Then those pricks (MM) had me send a text to them to complete the process. NO WAY – that just initiated this crap from a different source. Do what I did; contact your cell phone company, act real pissed, and make them eat the damn charge. They’ll act like it is not their fault, but they are complicit in this BS. Then have them put a block on your cell phone numbers (all of them) for “premium messages” (read high cost messages you never wanted). I also told all of these idiots that they can expect another lawsuit because they are entering into contracts for services; a) without proper agreement from the other party, and b) without verifying that the party “requesting” the services is of leagal age to enter into such an agreement.

Just noticed the same thing on one of our phones. First I’ve sent an email to Verizon for help; next I’m calling the Attorney Gernal’s office for my State; then I’m turning these people into the Better Business Bureau and the Consumer Protection Agency. I suggest the rest of you do the same, the more complaints States receive the better chance we have of stopping them from this illegal practice. I just filed a complaint with the FCC and gave them this link so they can see others who have fallen victim to this company.

Beware, the world is full of trickery. Mobile Messenger is the main criminal here, but other companies they are affiliated with are participating, possibly being accessories to a crime.In my example, last December I was on Facebook and a little message screen popped up (it looked like an official Facebook window) to say one of my friends was challenging me to an I.Q. test. After I took the I.Q. test I was asked to enter my cell phone # to receive a text message with the results. Yes, I know, it was my stupidity, I probably deserved to be scammed. But before hitting the submit button I read their terms/agreements and it said I would only be billed for downloading games, ringtones etc. So I didn’t think I’d be billed for getting the I.Q results.
I had topped up my Virgin Mobile pay as you go phone with $20, and Mobl. Messengr (herein referred to as “M M”)took $9.99 of it the next day. Virgin Mobile (“V M”) was no help at all. They kept saying the charge was from an outside provider and they had no responsibility. The only # they gave me was a M M automated # 800-235-7105 which gave you the option to be removed from receiving further charges. I entered my cell # and was told I wouldn’t be charged again. There was also an option to leave a voice message, which I did. The system told me someone would return my call, which they didn’t. I then went online and finally found a phone # of M M which had a live person to talk to. He told me they would refund my $9.99 with a check in the mail , and I replied that I didn’t want a check, I wanted my money back on my phone that they had stolen.
He asked me if I was refusing payment, in which case I would receive nothing. So I agreed to the check by mail, and received a check 3 weeks later.
Now here is part two of the story. Two months have passed since that incident and I didn’t receive any more charges or texts from M M, and I didn’t expect any because with their check they gave me a letter saying I’d be charged no more. Well, the reason I realize I wasn’t charged is because for two months I was on a monthly plan with V M, and had very little extra cash balance. But as soon as my plan was over a few days ago I put $20 on my V M phone and M M snatched up another $9.99 of it the next day. I will get my money back from M M, but again V M was no help whatsoever. (A little tip for anyone on V M, if you want to speak to a live advisor from the U.S. rather than the Phillipines, tell their automated system you want to “disconnect service”. I haven’t done that yet, but I might still do it after I use up my last $10 – if M M doesn’t steal it first.) I have already called the toll free # listed above, and M M replied that I wouldn’t be billed again. But how can I believe them. I am going to write to the FCC, Better Business Bureau, and I will mention Virgin Mobile too. I cannot believe that the only # V M will give out is M M’s automated # that doesn’t offer refunds. VM said, “that’s the only # we have”. I asked “There must be a lot of other unhappy people like me you have to deal with?” the supervisor said, “No, very few. Infact many of our customer download products from M M and are happy with their products” She even went to the extreme of stating that most of the calls they get are from people who haven’t been billed yet and want to know when the charge will go through.
I am going to spend a considerable amount of time in researching and fighting this criminality on both VM and MM’s part. It’s only $10 for me right now, but it’s wrong and it has to be stopped.

PS….try to get written proof of the charges they made to your cell phone account. Go to your cell phone provider’s webpage and click on your account and print it, or maybe you get a bill in the mail.

I received charges on my phone bill – I called Verizon immediately because I had blocked all of these from both of my daughter’s phones. I verified with Verizon that they did respond back “STOP” however they still charged my account!!! I don’t understand how these companies are still getting away with this even after class action suits are filed! If we try and withhold the money to pay these false advertisers then our phone account goes into collection – this is an utter disgrace!

I ASKED THEM TO JUST “PRESS A FEW KEYS ON THERE COMPUTERS AND INSTEAD OF SHOWING ME 10, 30, OR 60 DAYS OF MY RECORDS, OR,… THEY COULD BRING THEM UP 60 DAYS AT A TIME,… GUESS WHAT FOLKS, THEY REFUSED ME TO EVEN SEE THEM 60 DAYS AT A TIME. WHAT THE HELL DO WE DO NOW? Just wanted to let you all know that, after reading post #3, I called Mobile Messenger at 1-800-416-6129 (from the post) and spoke with a very polite customer service rep.
My daughter was charged $9.99 for two services she inadvertently subscribed to. Verizon was not helpful.
The cs rep asked for the phone number that was charged, pulled up info on the two services and immediately agreed to issue a check to me for $19.98. I will let you all know when I get the check, but at face value this certainly looks like a reasonable solution. Hope this helps some of you all.

If I agreed to anything it was without knowledge. AT&T has agreed to take the charges that haven’t been paid off, however, I don’t know how long I paid these charges before discovering I was being charged. Whoever is responsible for this should not be jailed, they should be staked out over a fire ant hill. Looks like any atty. would jump on this.

I emailed Verizon complaining about the charges I didnt sign up for, I was told how to go into my account and block them. But wasnt offered to have the charges removed. It was not until I filed a complaint with the State Attorney General that they removed the charges. I filed with the BBB and the FCC for fraudulent charges and the only office I’ve heard from is the Attorney General, if I hadnt filed with their office I dont think I would have gotten the credit on my account. If your cell phone carrier has email then send them an email and keep it. Keep their response to your email. Calling them is fine but when you email them you have a record of what they tell you. Anyone wanting to do a class action count me in.

I had this charge on my bill and luckily for me Verizon did remove it for me. They also told me to text stop/cancel to the site and they have to stop. It must work because I have not received a text in several days. Hopefully, my next bill will not have a charge on it because I will refuse to pay it. If I did something Like that to people I would be charged with fraud, locked up and the key thrown away. Legal extortion is what it is.

I just looked at my verizon wireless bill – are ya ready for this one – no less than six (6) charges in Feb for $9.99 and one for 99 cents. I also did the IQ test thing a month or so ago. They are nothing but thiefs. I called Verizon Wireless and was told to text “stop” to all the numbers and then I can put a block on but not before I stop the service or they will jsut continue to bill me. It sounds like Verizon is tired of eating the costs…

I got scammed by Mobile Messenger also. This was through Facebook: they have an IQ test. To get the results, you must type-in your cell phone number. DONT DO IT!!
If you do type in your number, you are in Mobile Messenging hell. You will be charged $9.99 per month. Here are some things you can do:
1) Stop the service. Call 800-235-7105. This is MMs number to unsubscribe. This might stop FUTURE charges but wont be a refund for the first charge.
2) Have your cell phone company “block” future “premium services”. This will also stop it.
3) To get a refund for the first $9.99 charge, from MM, you can try to call MM at 800-416-6129 and beg. They might send you a check.
4) Call your cell phone company and beg them to reverse the $9.99 charge. They will try to tell you the cant, but then can. Ask to speak to a supervisor. Explain the situation. They can if they want to.

Unicel just charged us $9.99 on behalf of Mobil Messaging because our 15 year old daughter put her cell phone number into an “IQ Test,” the fine print of which states “must be 18.” When we complained to Unicel, we were told we had to pay and were given a number to call for Mobil Messaging: 800 235-7105. The voice mail says someone will call back within 48 hours. We’ve left 2 messages and not heard back. A quick Google search of the number suggests it’s a scam. Unicel should know this. My daughter stumbled across this through Facebook and it’s deceptively packaged to look like a harmless, fun activity, but simply entering one’s cell phone # generates a $9.99/month charge without regard to the user’s age. According to sources online, there was already a class action lawsuit settled about this. “Settled” is a bit of a misnomer, since clearly the practice continues unabated. If the lawsuit ordered the company to cease and desist there is clearly a violation.
I filed an online complaint with the FCC and will look into doing the same with the state attorney general and the BBB for Mobile Messaging in CA. Please let me know what else I can do to get restitution. Thank you.

Wife’s phone got hit with 2 Mobile Messenger charges within 4 minutes of each other. Verizon Wireless only assisted with identifying a MM website and a txt message to send to cancel MM service. Had premium TXT services blocked. Followed all comments noted in the foregoing, 1-800-235-7105 worked to stop all future attempts at MM charges. Wife’s phone had to MM charges within 4 minutes of each other; she took the Facebook IQ test but says that she didn’t enter her cell phone number to accept charges for response. Oh well. Verizon was little help, only provided txt message to discontinue service. Fortunately this website had all of the pertient phone numbers: 1-800-235-7105 to stop service and, after waiting about 10 minutes in their pending phone pool, 1-800-416-6129 for a refund (wife even received a confirmation number for the refund).

My daughter was scammed with the IQ test. I paid the 1st 9.99 after lecturing her, didn’t realize it was a subscription until this month’s bill. Verizon was very helpful, gave instructions to stop (text STOP to 40544)and credited 2 charges.

Do not take the IQ test on Facebook! After weeks of my friends challenging me to the test, I reluctantly took it. I should have known something was wrong when the test required your cell phone number to receive a “PIN”. I tool this test late on March 31st, by April 1st, my account had $9.99 taken out of it! Due to me using a prepaid Alltel account, I was unaware of the charges until April 1st when I was unable to use my phone due to my account having a negative balance! Then was when I learned about a $9.99 charge which obviously on caused the negative balance on my account!

Just found this information after phoning Verizon last nite to find out what this charge was on my bill. Finally had it blocked mid-March but we have been billed for it on my son’s phone for the past year, at least. Only discovered in talking with him last nite that it was not something to which he had subscribed. We had no info about the class action case until today. Doesn’t seem to have been very widely publicized. And now the deadline is past for filing a claim. Lucky them, huh?

The cell phone companies will not put precautions against this type of practice, Because each one of them gets a percentage of the sale from MM each month.

The scam continues on. My mother, who is a senior, just got her recent bill from T-Mobile which had a $9.99 charge on it from this company. I called T-mobile to have this taken care of, and they told me i had to call mobile messenger. I called them directly, and they wanted my full name and address so that they could send me a refund check in the mail that will take 6-8 weeks. Complete garbage so i am now going to file a complaint.

I had to go through the BBB to get my money back from these people. They say they will get back to you in 48 hrs. I didn’t hear from them for 10 days. Then when they finally sent their response back to the BBB, they said they left me several messages. They contacted me once. Trying to make me look like the one at fault. I don’t think so. Thankfully, I’m getting my money back. But the rest of you that have cancelled properly, as I did, watch your bills, and if you still have a charge, file the complaint. It will work!

After signing up for facebook at the insistence of my friends.(it is all their fault) I too rec’d two 10.00 charges and a bunch of useless text messages. After digging around and calling phone numbers I finally found this page. So far success. I called the number mentioned by Tabitha and they cancelled the service. Hopefully that is the end of it.

started receiving unauthorized test msgs to the tune of 60 dollars in about 1 month even tho i had disabled the txt msg capabilities of my pre paid phone. virgin mobile very helpful in disputing the charges and telling me who was doing it and disabled all texting for my phone.

I received a $9.99 charge and figured out what had happened, so I followed their text instructions to cancel the text service (that I never wanted). I was then charged again on my most recent bill. This time I called to complain. I told them their methods were intentionally deceptive and bordered on being an illegal scam. I was quickly told I would get my money refunded. We’ll see if it actually happens. I suspect they count on people not taking it this far. I’m stunned that no one has put a stop to this operation. The one nice thing I will say, is the customer service lady I spoke with was very nice. I feel sorry for her having that job.

I just noticed that on my dad’s account, which I pay for, they have been charging for 2 services since Dec 08 for a total of $99.95 in fees. They are only refunding me $49.95, but I will pursue the balance. This is a complete scam and they prey on the elderly. It took me about a 1/2 hour of complaining to get their mailing address out of them. Virgin Mobile will not block these numbers either. Shame on all of them and their deceptive practices. Customer Service says that they can only tell how this was initiated. However, that is a bunch of lies to since my father doesn’t even know how to receive or pull up a text with this so called secret code.

Stepson got taken by this MM in April & May. Thank goodness, my husband and stepson have T-Mobile. They immediately refunded the 19.99 and blocked MM’s access to their numbers. I’m with Alltel, but Verizon bought them out, so when my contract is up in a few months, I’m going to join my husband and stepson with T-Mobile. T-Mobile doesn’t put up with scamming companies and takes care of it’s customers.

I looked at my Verizon bill today and just about flipped out…I had 5 $9.99 charges! I was able to cancel them all…just sent a text to the 5 digits that appeared before mmtxtalrt and in the text area typed the word “stop”. I’m pretty sure I was getting them through Facebook when those little ads come on. I had no clue I was getting a monthly charge. Live and learn.

Like many others, I was charged $9.99 a month for this so-called “premium text messaging service” and met with great resistance. A minor (my kid sister, who had a secondary phone on my cell account) had gone onto the website http://www.MyIQquiz.com and, in order to complete an “IQ quiz,” clicked a discreet “Agreement” that started the charges.
When I got the bill and finally came to understand the situation, I was told by my service provider (Verizon) that they could not cancel the service or reverse/refund any of the charges that had occurred, that I must contact the provider directly.
HERE’S WHERE I TELL YOU WHO THESE GUYS ARE AND WHERE THEY ARE HIDING, SO START TAKING NOTES:
Step 1: Text to 37215 from a phone registered on the account where the charges occurred, to stop the charges from repeating. TEXT THE WORD “CANCEL” OR “STOP.”
NOW…HOW TO GET BACK YOUR MONEY:
Step 2: Call 800-416-6129. Try speaking to a service representative (mine was “Iris”) to confirm the services have been stopped (get the Confirmation #; mine was a seven-digit number). Once they’ve confirmed that the charges have stopped, get the start and stop dates of service and cross-reference them with your cell phone bill charges, to make sure that when they quote charge amounts or offer you a refund amount you’ll know if they are covering the entire date range.
Once they have confirmed the charges, it’s time to confirm the dates and amounts, and demand a refund. Stick to your guns, they are polite but very resistant to the idea. Demand to speak to a supervisor (I spoke to “Patrick”).
They came up with only a 50% refund for me (I got back half because it was an uninformed minor who initially submitted for the “IQ Quiz” and she did not see the charges and, as it was not me, the named accountholder, who consented to the service agreement, I had the right to dispute the charges – however, they kept 50% because the contend that when the minor clicked on the box it was consent to charge – I was really ticked off but it wasn’t worth more of a fight).
I received a check a few weeks later for my refund, and it contained their mailing address. THE REASON WE COULDN’T FIND THEM IS THAT THEY ARE IN CANADA AND USING A DIFFERENT NAME THAN THE SERVICE THEY PROVIDE. HERE IS THEIR INFORMATION, RIGHT OFF OF THEIR LETTER:

Same thing with Flycell, my 14 year old son, under my cell plan, now has a 9.99 charge every month. When he sent a text to 97310 to stop, they replied saying he does not have a subscription. This is the 2nd month this has happened. We are currently with AT&T.

I was charged 9.99 for 14 months. I’ve seen it on my bill, but thought it was for something else. I didn’t question it until now. I’m with sprint. I called and a representative was able to refund all fourteen months and credit it to my current bill. They also blocked any future text message and charges from text chat. If you’re nice enough, your carrier just might help you.

I only knew about this charge when my mobile phone was turned off. The CSR asked me what those chargers were for 9.99 and 14.99. I have the unlimited data plan with Sprint so these extra charges were a flag to her. She blocked the services and told me to call the MM to have the money refunded back to me. She also took off my late charges. I was really pissed off. Like everyone else, Face-freaking-book IQ scam quiz. I posted on my home page to let all my friends know about this scam. I googled PlayPhone and they are sending me my check in 2 weeks. It took some time to find this one for Mobile Mgr, but I call the d 800.416.6129 and spoke to a live person. I’m suppose to get a check in 2 weeks. We’ll see. How is it we don’t know about this? I’m sure all of these companies know the deal and I guess just hope the masses don’t catch on to the scam. It’s good to know that boards like this are around so there is something we can do. Anything for a buck…money is tight and we all need as much as we can to survive.

Found out last night they had been siphoning funds out of our prepaid cell account since NOVEMBER. We don’t actually receive a billing statement and rarely add more than $10 at a time to the account, and use it so rarely, that we didn’t notice until we added a 20 credit yesterday and lost half of it immediately. Virgin Mobile was no help. they offered us 10 free minutes. I was given the name Manny at ext 4806 and was assured that he will be in the office on Monday am and will indeed refund every penny they have taken from our account. I’m not holding my breath.

I have just received two charges on my AT&T account from this Mobile Messenger and I have never even used one of their services! AT&T refused to help me. I tried to call Mobile Messanger and sat on hold for almost 45 minutes and then got a voicemail…I still haven’t received a call back. So it doesn’t appear that the 2008 law suite did anything to stop this company for doing bad business! $20.00 a month may be pocket change for them, but that’s gas for me!!

I don’t know if it works (since I was able to unsubscribe by responding with “STOP” to the original text message) but, you can call 800-235-7105 and enter the cell phone number for which you’re receiving text messages/charges to unsubscribe. Good luck! I wouldn’t hold my breath.

There are hundreds, if not thousands, of people who are still dealing with this issue. Just do a web search for “text 44999″ and wade through the 38,500 results. They are spread out all over the web with posts on various ripoff complaint sites. I am advocating a new class-action lawsuit, now that we have precident. I just wanted to update your feed with some info about this, in the event that someone else is dealing with this one as well.

My mother is 80 years old. She uses her cell for emergency purposes only, yet somehow ended up with charges from mobile messenger… 3 times in 4 months!!! I called and they told me that she signed up for the services through a website. She doesnt even know how to turn a computer on!!!!
So for those of you who say its the consumers fault for not reading the terms and conditions, you are dead wrong. Its a scam. Any random person can typein your number on a website and they will charge you. They dont even verify that the number is really yours.
I filed a complaint with my states general attorneys office, as well as the better business bureau. this has to stop

I am so sick of hearing how people are going to go sue their cell phone companies. I work for sprint customer care, and I don’t know about the rest of them, but WE DO ONLY HAVE THE ONE NUMBER!!! It sucks, yes i know! but how the heck can you possibly hold us responsible? We already paid for their no such thing service. We are already out the money anyway. You think we don’t want to help you? You think we don’t want to give it back to you? You think we think it right what there doing? Its not right and most of us can sympathize with you, but most of us like our job! We give you what they tell us to give you. And just so you know, you kill more bees with honey is SO TRUE> I don’t take it personally when people call in about these charges and similar companies, but to read these complaints, are you serious? It makes me sick. I’m so glad that I can finally say what I think! I don’t disagree that there is some shady stuff going on. And there are MORE COMPANIES. Guess we just have to start guarding our 10 digit phone numbers like our 10 digit social security numbers. It’s not fair. But when we say there’s nothing we can do, there’s REALLY NOTHING WE CAN DO!

here was an IQ test on my myspace that said my friends were challenging me to it. Knowing some people, when they see that it looks alot like the rest of the page they will click on it. It also said I will be only charged 9.99$ a month if I decided to download ringtones and backgrounds, which I did not. I just simply took the test, which claimed itself to be “free.” After taking the test, I topped up my phone balance (Virgin Mobile Pay as you go plan) for unlimited texting, but I did it 1 day early. When the day came that the money was supposed to go into texting (20.00$ a month) it didn’t, and it said “my cash balance was low.” I called Virgin Mobile (My phone company) and without doing any research about where the money had gone, they said I had used it in talking minutes. I was furious, then I spoke with another person there, and they explained to call a certain 1-800 number in order to file a complaint and get my money back from Mobile Messenger. I did, and I left a message on that number (nobody answered) and it said they will return my call in two days, they never did! I did actually get a hold of them on a different number after I did research – and they said they will send a check. I hope I actually get it, and now I have to change my number so I don’t get any more messages like it!

I tried and tried to unsubscribe from this service by the usc short code 36058 and they would not respond to the 10 cancel text messages. Anything I found online said it was associated with Mobile Messaging however when I contacted them – they were not the company this group is associated with. However, they were able to provide me with the a contact phone number of 1-877-734-2549. I called that number and all cancel through an automated system. I finally got a text saying that the service was cancelled! Thank you Mobile Messaging. Problem resolved supposedly I will see what my July statement says.

Verizon phone customer has a charge for premium texting to 36058. We have never done any of this. I have done a lot of research online tonight and boy have I learned a lot. I read Verizon gets a kickback for these services. The customer service reps insist you did something to do this but I know I have not. I am reading about grandmothers who are being billed for these services and they don’t even know how to text, much less turn on a computer. With all the lawsuits against these companies how is this still happening???

I received a text about myluvcrush.com with some PIN number. I never authorized it. I use Verizon (Alltel but Verizon bought them out) and they just told me anyone can put your phone number in for this crap, and they will bill Verizon, and it shows up on YOUR phone bill. That is identity theft and fraud. Verizon CSR Marvin, told me Verizon has no protocol for preventing this from happening. I replied to it “STOP” and got the reply “you are not subscribed to any services. please call xxx or email 800-235-7105 or email help@sms-helpdesk.com.
I put a premium messaging block on both my # and husband’s. Verizon informed me third party billing text messages like that can bill 9.95 per message. And it will show up on MY Phone bill? Oh heck no. AT&T will be finding a new customer. I never had this problem with Alltel, not ever.

a text message was sent and 9.99 was deducted from my account with virgin mobile. with numerous attempts on my behalf to speak with an “sms” representative no one was available. i am still waiting for my refund. i am willing to report this company to “bbb” and take further action. is anyone else willing to get involved?

to all the complaints regarding “sms”. i have taken action by filing a complaint with “bbb”. i would suggest to y’all you do the same to get results. they are actually stealing from us “poor” consumers. if we do this we will get results!

I also have 2 separate charges on my phone (only one line). They were both done on August 29 with separate short codes. AT&T was super and took the charges off without hesitation. I didn’t subscribe to 2 accounts of Horoscope Alerts. I have never heard of anything like this and feel grossly violated. What’s this world coming to? I thought there was a Class Action against these people a year ago and apparently it’s still happening. I agree. I’m going to the Better Business Bureau.

My 74-year-old mother did this in Face Book. She is on my US Cellular bill, which I pay for 100%. I noticed a $9.99 charge on 8/2009 bill and, called US Cellular where they told me after much prompting that it occurred not only in July but in May and June as well. So basically $30 in charges! Then US Cellular told me that I could have this type of subscription cancelled from them from even happening. So make sure that you cancel this on your phone company or the next time you’re in a quiz, it could happen again. I figured out that it was probably a quiz or something as I back out of that stuff when it comes up. My non-technological 74-year-old mother did not. Therefore, she’s punching in numbers for fun! I cancelled the ability for future scammers to bill our phones anymore on 8/24/09. Unfortunately, the 3 previous $9.99 charges happened on 5/21/09, 6/21/09 and 7/21/09. I called the 800-235-7105 number to cancel and was refunded the $9.99 x 3 months from Mobile Messenger. So here it is a month later in 9/2009 with 3 more charges completed on 8/21/09. So, I call back again for a refund and they tell me that it’s their policy to only refund 50% of the charges. Does anyone know where to report this scam to get your $$$ back? I’ll be posting this on FB to all my friends!

Well it appears that you guys at mobile Messanger get a copy of this message; so who are your corporate officers and where are you incorporated at? It appears that it is time to file criminal charges of theft by deception against your corporate officers. Yes you may agree to refund half of the money, by you still keep half the money on this scam! Not on my watch! Yes, it maybe only $9.99; however, judging by all of the post on this site, I’m not the only victim. I tried calling the 800 number and it rings busy. So maybe you’ll respond to this post. I plan on posting this message on every site avaiable to seek a criminal complaint in the State Of Florida. So, if anyone who is in the State of Florida and would like to support my effort to seek a criminal complaint against this company please let me know.

I just at verizon store where I just learned of of $140.00 of unauthorized charges to my phone .. all with PREM_SMS AND A 5 DIGET NUMBER for mxtelecom alerts, ringtonetop21721,www.sendmemobilecom, mmtxtalrt,solow.com, 2waytraffic alerts,mbmobile alerts … each charge was 9.99. So i have been going on line to check who these companies are and i have no ideal and never subscribed to anything ..but yet i am getting charged all these fees from these companies .. i call one .. sendmemobilecom and canceled everything and then i called another solow.com and got the same company sendmemobile.com. So i believe all these charges are coming for the same company. i am going to call more to find out if i can find them online but will be using my house phone so that they can not charge me for anything or say that i called them and subscribed. THIS IS A BIG SCAM AND WE ALL NEED TO GET OUR MONEY BACK. THIS COMPANY AND OTHER COMPANIES THAT ARE DOING THIS NEED TO BE FINED BIG TIME FROM THE GOVERMENT FOR DOING THIS TO THE PUBLIC.

Just found out something from one of those premium txt messages company .. if you contact your phone carrier and request a “SHORT CODE SERVICE BLOCK” these companies will not be able to send you any 5 diget number to your phone.

I just acquired two of these charges on my latest bill. I called Sprint and they had them removed within a matter of minutes. They also blocked all 3rd party charges to my account.

Taylor: I’m dealing with Virgin Mobile, which is a Sprint reseller. They won’t give a refund and claim they are unable to block such charges or the messages associated with them. I started getting the charges completely out of the blue. I’d had no interaction with Mobile Messenger and had never heard of the until Virgin Mobile told me who they were.

In my email exchanges with Virgin Mobile, I have discovered that they are no longer a Sprint reseller. Sprint bought them from Virgin some time ago, and they are now a Sprint subsidiary. Obviously, the deal gave Sprint the rights to the Virgin Mobile name and trademark.
I note that someone posting here received a refund from Sprint. Virgin Mobile tells me that, although they are a Sprint subsidiary, they have different policies. Apparently, one difference is that they don’t maintain the same ethical standards as Sprint.
I have had unauthorized charges on landline phone bills a number of times in the past. Every time that happened, the phone company credited my account without question, simply accepting that it was their responsibility and that they were the ones who should go after the person or organization responsible for the abuse.
